Grounds for divorce under Thai law (Civil & Commercial Code §1516)

  • Mutual consent — 30-minute Amphur filing, no court, no waiting period.
  • Fault grounds — adultery (with material evidence), desertion 1+ year, criminal conviction 1+ year prison, physical/mental abuse, incurable insanity 3+ years, communicable disease, unreasonable failure to support.
  • No-fault — Thailand does NOT have pure irreconcilable-differences divorce like California. You must fit a statutory ground OR file mutual consent.
  • Foreign judgments — Thai courts recognize foreign divorces if properly legalized and the foreign court had jurisdiction.

Cross-border child custody & the Hague Convention

  • Thailand acceded to the Hague Convention on Child Abduction on 1 November 2002 (in force from 1 August 2013).
  • Central Authority: Ministry of Social Development and Human Security (MSDHS).
  • Return applications are processed via the Thai Central Authority to the Juvenile & Family Court. Typical timeline: 6–18 months.
  • Common trap — passports issued by the child's other-country nationality can be surrendered by that embassy; secure a court order before the child leaves.

A marriage or divorce only has legal effect in Thailand once it is registered by a district registrar, and a ceremony on its own does not create that status. For foreign nationals the paperwork travels through an embassy and the Ministry of Foreign Affairs before the registrar will act, and recognition in the other country is a separate question decided under that country's law.

    Thai district offices ask a foreign national to produce a statement from their embassy in Thailand confirming they are free to marry. The embassy sets its own booking process and evidence requirements, and the resulting document then needs Thai certification and a Thai translation before the registrar will accept it. Book that appointment first, because it usually sets the timetable for everything else.

    Under Thai law an agreement about matrimonial property must be made and recorded in connection with the registration itself to be effective.     A Thai marriage or divorce certificate normally has to be certified by the Ministry of Foreign Affairs and translated before another country's registry, immigration authority or court will act on it.     Where children are involved, the birth registration, any acknowledgement of paternity and the record of parental power should be consistent with the marital status being registered. Mismatched records surface later at passport renewal, school enrolment or travel, at which point correcting them is slower than doing it now.

    A religious or customary ceremony in Thailand, however formal, does not register the marriage. Couples sometimes discover years later, when applying for a spouse visa or dealing with an estate, that no registration exists.     Registrars and foreign authorities look for a translation that can be traced to an identified translator and, where required, carries Ministry of Foreign Affairs certification.     A consent divorce settles property, and often arrangements for children, in a single document. Signing a Thai-language agreement without an accurate translation, or an English draft that differs from the Thai text filed, creates disputes that are far harder to unwind afterwards. Have both versions checked against each other before the appointment.

    Recognition of a foreign judgment is decided under the receiving country's rules and is not automatic in either direction.
