Notary Public in Thailand — Notarial Services Attorney (English-language service)

Thailand does not operate a US-style Notary Public system. Instead, the Lawyers Council of Thailand licenses Notarial Services Attorneys to authenticate signatures, certify true copies, and administer oaths (Affidavits). This is the mechanism accepted by US, UK, Australia, Canada, and 128 Hague Apostille countries. Practical guidance and pitfalls — Notarial Services Attorney in Thailand

Thailand has no Notary Public office in the common-law sense. Notarial acts are performed by a lawyer registered as a Notarial Services Attorney with the Lawyers Council of Thailand, and the certificate they issue is normally the first link in a longer authentication chain rather than the final step.

    Bring the original identity document to the appointment, not a scan on a phone

    The attorney certifies that the person in front of them is the person named in the document, so the physical passport or identity card must be inspected on the day. A photograph or photocopy gives no basis for that statement and the appointment cannot proceed on it.

    A signature witnessed in person is the substance of the act. Documents that arrive already signed generally have to be reprinted and executed again, which is awkward when the counterparty abroad has already numbered the pages or when the form is a single-copy original.

    Depending on the destination the notarial certificate may need onward authentication by the Thai Ministry of Foreign Affairs and, for some countries, by the destination embassy. Each stage has its own lead time, so plan the sequence backwards from the date the document must be in the recipient's hands.

    The attorney must see who is entitled to bind the company on that day, which normally means a recently issued company affidavit or certificate from the Department of Business Development together with the director's identity document. Extracts printed months earlier are often declined because directorships change.

    The signer must understand what they are executing. Where the text is in a language the signer does not read, having an interpreter present and recorded in the certificate protects the document against a later claim that consent was not informed, which is exactly the argument foreign courts examine first.

    The act attests to identity, signature, capacity or the fidelity of a copy, not to the accuracy of the underlying assertions. Parties who rely on it as proof of the facts stated are relying on something the certificate never said, and that misunderstanding surfaces painfully in disputes.

    Describing the service to a foreign counterparty as a Notary Public without explanation

    A recipient expecting a civil-law notary may reject a Thai certificate simply because the title does not match. It is worth telling the counterparty in advance that Thailand uses Notarial Services Attorneys registered with the Lawyers Council, so the difference is understood before the document is examined.

    An Apostille is a separate certificate issued by a designated competent authority under the 1961 Hague Convention. Where the destination is a Convention party, the notarial act is only the document that the Apostille will later be attached to; confirm current Thai arrangements before assuming either route.

    Even if the passport is technically valid on the day of signing, downstream offices may compare it against their own validity rules weeks later. Renewing first, and using the new number consistently across the whole bundle, avoids a mismatch that is expensive to correct after legalisation has begun.

    Asking for a certified true copy to be made from another copy

    A true copy certificate compares the copy against the original in the attorney's presence. If only a photocopy or a printed scan is available, there is nothing authoritative to compare against, and the resulting certificate would be misleading, so the request cannot be met.

    Translating the document only after it has been certified

    When translation is left to the end, the certificate, seal and any endorsements added during certification fall outside the translated text, and the receiving office sees untranslated content on the face of the document. Agree the order of translation and certification with the destination's requirements in mind.
